Modern Methods of Evidence in Non-Financial Personal Status Cases (An Applied Legal Study)

Abstract
Contemporary scientific and technological advancements have introduced new methods of proof previously unknown within the framework of traditional rules of evidence. This has raised numerous legal issues concerning the admissibility of these methods and their applicability in court, particularly in non-financial personal status cases, which are characterized by their specific subject matter and close connection to the family system. The research problem lies in determining the validity of these modern methods of proof in this type of case, clarifying the position of Iraqi legislation and the judiciary regarding them, and assessing the adequacy of existing legal texts to keep pace with scientific developments in the field of evidence.This research aims to analyze the legal framework of modern methods of proof in non-financial personal status cases, clarify the limits of their legal admissibility, and highlight their most important practical applications, such as DNA fingerprinting and modern electronic means, and the extent to which they can be utilized in uncovering the truth in court. The research adopted an analytical approach to relevant legal texts, particularly the provisions of the Iraqi Evidence Law and the Personal Status Law, as well as an applied approach through a review of some judicial trends and scholarly opinions that addressed these methods of proof. The research concluded with a number of findings, most notably that modern methods of proof represent an effective tool that can contribute to strengthening the role of the judiciary in achieving justice and revealing the truth. However, their application in non-financial personal status cases should be within the framework of precise legal and judicial controls that ensure a balance between the requirements of proof on the one hand and the protection of family privacy and stability on the other. The research recommended the necessity of developing Iraqi legislation related to evidence in line with the rapid scientific and technological advancements in this field.
